421-a Completion of Construction Extension. Are you vested?

In April of this year, Governor Kathy Hochul announced a welcome extension of the 421a construction completion deadline for select projects. To take advantage of this opportunity, developers of projects that commenced construction prior the Commencement Deadline, must submit a Letter of Intent to HPD by September 12, 2024.

The LOI is non-binding, which means that if your project is completed before the original June 2026 deadline, you won’t be obligated to meet the deeper affordability requirements associated with the extension. Filing the LOI simply preserves your options to complete construction all the way through June 15, 2031 and does not commit you to these extended requirements if you finish prior to the original deadline.
